Erb's Palsy

As a birth injury Erb’s Palsy can be mistaken for Brachial Palsy. The San Jose birth injury attorneys of The Mitchell Law Firm explain how they differ and your lawsuit options.

Brachial palsy, or brachial plexus palsy, refers to conditions that occur, usually during birth, because of damage to the brachial plexus.  The brachial plexus is the network of nerves that extend from the spine/neck area to the upper arm, and control nerves in the arm and hand.  Injury to the five nerves which make up the brachial plexus cause Erb’s and Klumpke’s palsy.

Erb’s palsy is a condition of brachial palsy where the upper nerves of the brachial plexus are injured.  The injury can be mild or as serious as a total separation of the nerve, called an avulsion.  A baby with Erb’s palsy will have a limb that lies limp at the side. Infants with Erb’s palsy often have a stiff elbow with a backward turned hand on the affected limb.

Mild cases of Erb’s palsy, caused by bruising, may heal on their own or with physical therapy.  More serious cases require surgery.  If a case of Erb’s palsy has not been corrected by age one, it is thought that the damage is permanent, and arthritis, stunted growth, weakness or paralysis may occur in the affected arm and hand.

Klumpke’s palsy is also caused by damage to nerves in the brachial plexus, but affects the upper part of the limb.  It is considered to be far rarer than Erb’s palsy.  Both Klumpke’s and Erb’s palsy are evident from birth, and a quick diagnosis and treatment is imperative for recovery.

Brachial plexus injuries are often caused by medical malpractice during the birth process.  Use of suction and forceps, difficult and long deliveries, large babies, breech births, and pressure on the head and neck can lead to these types of injuries.  If your child suffers from a brachial plexus injury it is important to consult with an attorney engaged in birth injury law, personal injury law, medical malpractice law, or a plaintiff’s attorney to find out about your legal options.  There is a short period of time in which to file a lawsuit, so it is important that you do not delay in getting legal advice.
